This Privacy Policy (“Policy”) describes how BasketBid (“BasketBid”, “we”, “our”, or “us”) collects, uses, discloses, stores, and protects personal data in connection with the operation of its digital marketplace platform, website, applications, and related services (collectively, the “Platform”).

BasketBid is a Saudi Arabia–based business-to-business (B2B) marketplace. By accessing or using the Platform, you acknowledge that you have read, understood, and agreed to this Policy.

1. Regulatory & Legal Framework

This Policy is prepared in accordance with:

• Saudi Personal Data Protection Law (PDPL)
• Applicable regulations issued by SDAIA
• Other relevant Saudi laws and regulatory requirements

Where required, BasketBid will obtain user consent before processing personal data.

2. Applicability & Capacity

This Policy applies to:

• Businesses and their authorized representatives
• Buyers and suppliers using the Platform
• Visitors to the Platform

By using the Platform, you confirm that:

• You are acting on behalf of a business entity, or
• You are legally authorized to provide personal data related to a business entity

BasketBid does not knowingly collect personal data from minors.

3. Categories of Personal Data Collected

BasketBid may collect the following categories of data:

3.1 Business & Identification Data

• Full name
• Company name
• Commercial Registration (CR) details
• VAT number (if applicable)
• Job title and authority level

3.2 Contact Data

• Business email address
• Mobile or telephone number
• Business address and city

3.3 Platform & Transactional Data

• Account login credentials
• RFQs, quotations, transaction records
• Communications exchanged on or through the Platform
• Payment-related references (excluding full card data)

3.4 Technical & Usage Data

• IP address
• Browser and device information
• Log files and usage analytics
• Cookies and tracking technologies

4. Purpose Limitation (Why We Process Data)

BasketBid processes personal data strictly for legitimate business purposes, including:

• User registration and account management
• Verification of business identity
• Facilitating RFQs, quotations, and transactions
• Enabling communication between users
• Platform security and fraud prevention
• Customer support and dispute handling
• Legal, regulatory, and compliance obligations
• Analytics, system improvement, and operational efficiency

BasketBid does not process personal data for purposes incompatible with the above.

5. Lawful Basis for Processing

Personal data is processed based on one or more of the following lawful bases:

• Explicit user consent
• Performance of contractual obligations
• Compliance with legal or regulatory requirements
• Legitimate interests of BasketBid, where permitted by law and not overriding user rights

6. Data Sharing & Disclosure

BasketBid does not sell or rent personal data. We may disclose personal data only to:

• Other platform users strictly as required to complete transactions
• Payment processors and logistics partners
• IT, hosting, and cloud service providers
• Professional advisors (legal, accounting, audit)
• Government or regulatory authorities where legally required

All third parties are required to maintain confidentiality and data protection standards.

7. Cross-Border Data Transfers

Where business operations require processing outside Saudi Arabia, BasketBid ensures:

• Compliance with PDPL cross-border transfer rules
• Adequate data protection safeguards
• Transfer only for legitimate business purposes

8. Data Retention

Personal data is retained only as long as necessary for the purposes stated. Certain data may be retained longer where required by law, regulation, or dispute resolution. Data deletion requests are subject to legal and regulatory obligations.

9. Data Security Measures

BasketBid implements reasonable administrative, technical, and organizational safeguards to protect personal data against:

• Unauthorized access
• Loss, misuse, or alteration
• Unauthorized disclosure

Despite these measures, no electronic transmission or storage system is completely secure, and BasketBid does not guarantee absolute security.

10. User Rights

Subject to applicable law, users may request to:

• Correct inaccurate or outdated data
• Withdraw consent (where applicable)
• Request deletion where legally permissible

Requests must be submitted through official BasketBid channels and may be subject to identity verification.

Users may disable cookies via browser settings, which may affect Platform functionality.

12. Third-Party Platforms

The Platform may contain links to external websites or services. BasketBid is not responsible for the privacy practices, content, or security of third-party platforms.

13. Limitation of Liability

To the maximum extent permitted by Saudi law:

• BasketBid shall not be liable for indirect, incidental, or consequential damages related to data use
• Users acknowledge that data shared with other users is done at their own business discretion

14. Future Services (B2C Readiness Clause)

BasketBid may introduce business-to-consumer (B2C) services in the future. This Policy may be updated accordingly, and additional notices or consents may be required.

15. Amendments

BasketBid reserves the right to amend this Policy at any time. Updated versions will be published on the Platform with the revised date. Continued use of the Platform constitutes acceptance of the revised Policy.

16. Governing Law & Jurisdiction

This Policy shall be governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia. Saudi courts shall have exclusive jurisdiction.

BasketBid هي سوق أعمال-إلى-أعمال (B2B) مقرها المملكة العربية السعودية. من خلال الوصول إلى المنصة أو استخدامها، فإنك تقر بأنك قد قرأت وفهمت ووافقت على هذه السياسة.

1. الإطار التنظيمي والقانوني

تم إعداد هذه السياسة وفقاً لـ:

• نظام حماية البيانات الشخصية السعودي (PDPL)
• التنظيمات الصادرة عن الهيئة السعودية للبيانات والذكاء الاصطناعي (SDAIA)
• القوانين والمتطلبات التنظيمية السعودية الأخرى ذات الصلة

حيثما يلزم، سيحصل BasketBid على موافقة المستخدم قبل معالجة البيانات الشخصية.

2. نطاق التطبيق والقدرة

تنطبق هذه السياسة على:

• الشركات وممثليها المخولين
• المشترين والموردين الذين يستخدمون المنصة
• زوار المنصة

باستخدام المنصة، فإنك تؤكد أن:

• أنت تتصرف نيابة عن كيان تجاري، أو
• أنت مخول قانونيًا لتقديم البيانات الشخصية المتعلقة بالكيان التجاري

لا يقوم BasketBid بجمع البيانات الشخصية من القاصرين عن عمد.

3. فئات البيانات الشخصية التي يتم جمعها

قد يقوم BasketBid بجمع الفئات التالية من البيانات:

3.1 البيانات التجارية والتعريفية

• الاسم الكامل
• اسم الشركة
• تفاصيل السجل التجاري (CR)
• رقم ضريبة القيمة المضافة (إن وجد)
• المسمى الوظيفي ومستوى الصلاحية

3.2 بيانات الاتصال

• البريد الإلكتروني التجاري
• رقم الهاتف أو الجوال
• العنوان التجاري والمدينة

3.3 بيانات المنصة والمعاملات

• بيانات تسجيل الدخول للحساب
• طلبات عروض الأسعار (RFQs)، عروض الأسعار، سجلات المعاملات
• الاتصالات المتبادلة على المنصة أو من خلالها
• مراجع الدفع (باستثناء بيانات البطاقة الكاملة)

3.4 البيانات التقنية وبيانات الاستخدام

• عنوان IP
• معلومات المتصفح والجهاز
• ملفات السجل وتحليلات الاستخدام
• الكوكيز وتقنيات التتبع

4. الغرض من معالجة البيانات

يعالج BasketBid البيانات الشخصية لأغراض تجارية مشروعة فقط، بما في ذلك:

• تسجيل المستخدم وإدارة الحساب
• التحقق من هوية الشركة
• تسهيل طلبات عروض الأسعار والمعاملات
• تمكين التواصل بين المستخدمين
• أمن المنصة ومنع الاحتيال
• دعم العملاء وحل النزاعات
• الالتزام القانوني والتنظيمي
• التحليلات وتحسين النظام والكفاءة التشغيلية

لا يقوم BasketBid بمعالجة البيانات الشخصية لأغراض تتعارض مع ما سبق.

5. الأساس القانوني للمعالجة

يتم معالجة البيانات الشخصية بناءً على أحد الأسس القانونية التالية:

• موافقة المستخدم الصريحة
• أداء الالتزامات التعاقدية
• الامتثال للقوانين أو المتطلبات التنظيمية
• المصالح المشروعة لـ BasketBid، حيثما يسمح القانون ودون تجاوز حقوق المستخدم

6. مشاركة البيانات والكشف عنها

لا يقوم BasketBid ببيع أو تأجير البيانات الشخصية. قد يتم الكشف عن البيانات الشخصية فقط إلى:

• المستخدمين الآخرين على المنصة وفقًا لما يلزم لإتمام المعاملات
• معالجي الدفع وشركاء الخدمات اللوجستية
• مزودي خدمات تكنولوجيا المعلومات والاستضافة والسحابة
• المستشارين المهنيين (قانونيين، محاسبين، مراجعين)
• الجهات الحكومية أو التنظيمية عند الحاجة القانونية

يتعين على جميع الأطراف الثالثة الحفاظ على السرية ومعايير حماية البيانات.

7. نقل البيانات عبر الحدود

عندما تتطلب العمليات التجارية معالجة البيانات خارج المملكة العربية السعودية، يضمن BasketBid:

• الامتثال لقواعد PDPL للنقل عبر الحدود
• وجود تدابير حماية بيانات مناسبة
• النقل لأغراض تجارية مشروعة فقط

8. الاحتفاظ بالبيانات

يتم الاحتفاظ بالبيانات الشخصية فقط طالما كانت ضرورية للأغراض المذكورة. قد يتم الاحتفاظ ببعض البيانات لفترة أطول إذا كان ذلك مطلوبًا بموجب القانون أو التنظيم أو حل النزاعات. طلبات حذف البيانات تخضع للالتزامات القانونية والتنظيمية.

9. تدابير أمن البيانات

يطبق BasketBid تدابير إدارية وتقنية وتنظيمية لحماية البيانات الشخصية من:

• الوصول غير المصرح به
• الفقدان أو سوء الاستخدام أو التغيير
• الكشف غير المصرح به

رغم هذه التدابير، لا يوجد نظام إلكتروني آمن تمامًا، ولا يضمن BasketBid الأمان المطلق.

10. حقوق المستخدم

بموجب القانون المعمول به، يمكن للمستخدمين طلب:

• الوصول إلى البيانات الشخصية
• تصحيح البيانات غير الدقيقة أو القديمة
• سحب الموافقة (إن وجدت)
• طلب الحذف حيثما يسمح القانون

يجب تقديم الطلبات عبر القنوات الرسمية لـ BasketBid وقد تخضع للتحقق من الهوية.

11. الكوكيز وتقنيات التتبع

يستخدم BasketBid الكوكيز والتقنيات المماثلة لـ:

• الحفاظ على وظائف المنصة
• تحسين الأداء وسهولة الاستخدام
• تحليل سلوك المستخدمين بشكل جماعي

يمكن للمستخدمين تعطيل الكوكيز عبر إعدادات المتصفح، مما قد يؤثر على وظائف المنصة.

12. المنصات الخارجية

قد تحتوي المنصة على روابط لمواقع أو خدمات خارجية. لا يتحمل BasketBid مسؤولية ممارسات الخصوصية أو المحتوى أو أمان المنصات الخارجية.

13. تحديد المسؤولية

إلى أقصى حد يسمح به القانون السعودي:

• لا يتحمل BasketBid المسؤولية عن الأضرار غير المباشرة أو العرضية أو التبعية المتعلقة باستخدام البيانات
• يقر المستخدمون بأن البيانات المشتركة مع المستخدمين الآخرين تتم وفقًا لتقديرهم التجاري الخاص

14. الخدمات المستقبلية (إمكانية تقديم خدمات B2C)

قد يقدم BasketBid خدمات أعمال-إلى-مستهلك (B2C) في المستقبل. قد يتم تحديث هذه السياسة وفقًا لذلك، وقد تكون هناك حاجة لإشعارات أو موافقات إضافية.

15. التعديلات

يحتفظ BasketBid بالحق في تعديل هذه السياسة في أي وقت. سيتم نشر النسخ المحدثة على المنصة مع تاريخ التعديل. استمرار استخدام المنصة يعتبر قبولًا بالنسخة المعدلة.

16. القانون والاختصاص القضائي

تخضع هذه السياسة وتفسر وفقًا لقوانين المملكة العربية السعودية. للأحكام القضائية السعودية الاختصاص الحصري.
