Basketbid Terms and Conditions

Adjustment of Vendor Payments

Refunds or dispute resolutions, including those related to cash payments, shall be deducted from the vendor’s online payment balance, if any. Basketbid shall adjust the net amount remitted to the vendor, after accounting for applicable commissions and payment processing charges.

Online Payment Refunds

For online payments processed through Basketbid, approved refunds shall be processed through our platform, subject to applicable service fees and payment processing policies and charges.

Buyers must initiate return requests through Basketbid, which will facilitate communication with vendors to resolve issues related to non-conforming products identified at delivery.

Returns must comply with the Saudi E-Commerce Law, which permits returns within 7 days for eligible products, unless otherwise specified by the vendor or restricted by the requirement to verify quality and quantity at delivery, except editable goods.

User Accounts

Registration of an account on the Site is mandatory for buyers to place orders and for vendors to list products or services.

Vendors must provide proof of authentic commercial registration issued by the Saudi Ministry of Commerce during account setup with registered national address, bank account detail, communication information (mobile, email), VAT certificate if available, and other documents required by local laws in the Kingdom of Saudi Arabia.

Users are responsible for maintaining the confidentiality of their account credentials and for all activities conducted under their accounts. Users shall promptly notify Basketbid of any unauthorized use of their accounts.

Account activities must comply with Saudi Arabia’s Anti-Cyber Crime Law.

Intellectual Property

All content on the Site, including logos, text, designs, and graphics, is the property of Basketbid or licensed to us and is protected under Saudi intellectual property laws.

Vendor content (e.g., product descriptions, images) remains the property of the respective vendor but may be used by Basketbid for platform purposes, as stipulated in the vendor agreement.

No content from the Site may be reproduced, distributed, or used without prior written permission from Basketbid or the respective vendor. Any unauthorized use of content may result in legal action under Saudi intellectual property laws.

Prohibited Uses

You are prohibited from using the Site or its content:

• For any unlawful purpose or in violation of Saudi laws, including the Anti-Cyber Crime Law or E-Commerce Law;
• To solicit others to engage in unlawful acts;
• To upload false, misleading, or fraudulent information;
• To infringe upon the intellectual property rights of Basketbid or third parties;
• To interfere with the Site’s operations, security, or functionality;
• To involve or use the system for money laundering purposes.

Disclaimer of Warranties; Limitation of Liability

The Site and services are provided on an “as is” and “as available” basis without warranties of any kind, express or implied, to the fullest extent permitted by Saudi law.

Basketbid does not warrant the accuracy, completeness, or reliability of vendor-provided information or the uninterrupted or error-free operation of the Site.

Basketbid shall not be liable for any injury, loss, claim, or damages arising from transactions, vendor products, or use of the Site, except as mandated by Saudi consumer protection laws.

Basketbid’s liability, if any, shall be limited to the amount of fees collected from the specific transaction, unless otherwise required by Saudi law.

Indemnification

You agree to indemnify, defend, and hold harmless Basketbid, its owners, employees, affiliates, and agents from any claim, demand, or liability arising from your breach of these Terms, violation of Saudi laws, or misuse of the Site, including reasonable legal fees.

Governing Law and Dispute Resolution

These Terms are governed exclusively by the laws of the Kingdom of Saudi Arabia. Any disputes arising from these Terms or use of the Site shall be resolved in the competent courts of Riyadh, Saudi Arabia, in accordance with Saudi legal procedures.

Amendments to Terms

Basketbid reserves the right to amend or update these Terms at any time. Amendments shall take effect immediately upon posting to the Site. Continued use of the Site following such amendments constitutes your acceptance of the revised Terms.

شروط وأحكام باسكتبيد

تسوية مدفوعات البائعين

سيتم خصم المبالغ المستردة أو تسويات النزاعات، بما في ذلك تلك المتعلقة بالمدفوعات النقدية، من رصيد مدفوعات البائع عبر الإنترنت إن وجد. سيقوم باسكتبيد بتعديل المبلغ الصافي المحول إلى البائع بعد خصم العمولات ورسوم معالجة الدفع المطبقة.

استرداد المدفوعات عبر الإنترنت

في حالة المدفوعات التي تمت عبر منصة باسكتبيد، سيتم تنفيذ المبالغ المستردة المعتمدة من خلال منصتنا، وذلك وفقًا للرسوم وسياسات معالجة الدفع المعمول بها.

يجب على المشتري تقديم طلبات الإرجاع عبر باسكتبيد، حيث سيتم تسهيل التواصل مع البائعين لحل المشكلات المتعلقة بالمنتجات غير المطابقة التي تم اكتشافها عند التسليم.

يجب أن تتوافق عمليات الإرجاع مع نظام التجارة الإلكترونية في المملكة العربية السعودية، والذي يسمح بإرجاع المنتجات المؤهلة خلال 7 أيام، ما لم ينص البائع على خلاف ذلك أو تمنعها متطلبات التحقق من الجودة والكمية عند التسليم، باستثناء المنتجات القابلة للتعديل.

حسابات المستخدمين

يجب تسجيل حساب على الموقع ليتمكن المشتري من تقديم الطلبات والبائع من عرض المنتجات أو الخدمات.

يجب على البائعين تقديم إثبات التسجيل التجاري الأصلي الصادر عن وزارة التجارة السعودية عند إنشاء الحساب، مع عنوان وطني مسجل، وتفاصيل الحساب البنكي، ومعلومات التواصل (الجوال، البريد الإلكتروني)، وشهادة ضريبة القيمة المضافة إن وجدت، وأي مستندات أخرى مطلوبة وفق الأنظمة المحلية في المملكة.

يتحمل المستخدمون مسؤولية الحفاظ على سرية بيانات الدخول الخاصة بهم وعلى جميع الأنشطة التي تتم من خلال حساباتهم. يجب على المستخدمين إخطار باسكتبيد فوراً بأي استخدام غير مصرح به لحساباتهم.

يجب أن تتوافق أنشطة الحساب مع نظام مكافحة جرائم المعلوماتية في المملكة.

الملكية الفكرية

جميع المحتويات على الموقع، بما في ذلك الشعارات والنصوص والتصاميم والرسوم، هي ملك لباسكتبيد أو مرخصة لنا، وهي محمية بموجب قوانين الملكية الفكرية في المملكة العربية السعودية.

تظل محتويات البائع (مثل وصف المنتجات والصور) مملوكة للبائع المعني، ولكن يمكن استخدامها من قبل باسكتبيد لأغراض المنصة، كما هو منصوص عليه في اتفاقية البائع.

لا يجوز نسخ أو توزيع أو استخدام أي محتوى من الموقع بدون إذن كتابي مسبق من باسكتبيد أو البائع المعني. أي استخدام غير مصرح به قد يعرض المخالف للمساءلة القانونية بموجب قوانين الملكية الفكرية السعودية.

الاستخدامات المحظورة

يُحظر عليك استخدام الموقع أو محتواه:

• لأي غرض غير قانوني أو مخالف لأنظمة المملكة، بما في ذلك نظام مكافحة جرائم المعلوماتية أو نظام التجارة الإلكترونية؛
• لتحريض الآخرين على القيام بأعمال غير قانونية؛
• لتحميل معلومات زائفة أو مضللة أو احتيالية؛
• لانتهاك حقوق الملكية الفكرية الخاصة بباسكتبيد أو أطراف ثالثة؛
• للتدخل في تشغيل أو أمان أو وظائف الموقع؛
• لأغراض غسل الأموال أو استخدام النظام بطريقة غير قانونية.

إخلاء المسؤولية؛ حدود المسؤولية

يتم تقديم الموقع والخدمات كما هي ووفقاً لما هو متاح، بدون أي ضمانات صريحة أو ضمنية، وذلك إلى أقصى حد يسمح به القانون السعودي.

لا تضمن باسكتبيد دقة أو اكتمال أو موثوقية المعلومات المقدمة من البائعين أو تشغيل الموقع دون انقطاع أو أخطاء.

لا تتحمل باسكتبيد أي مسؤولية عن أي ضرر أو خسارة أو مطالبة ناتجة عن التعاملات أو المنتجات المقدمة من البائعين أو استخدام الموقع، باستثناء ما تنص عليه قوانين حماية المستهلك في المملكة.

إذا تم تحميل باسكتبيد مسؤولية قانونية، فستكون تلك المسؤولية محدودة بمقدار الرسوم التي تم تحصيلها من المعاملة المحددة، ما لم ينص القانون السعودي على خلاف ذلك.

التعويض

توافق على تعويض باسكتبيد ومالكيها وموظفيها وشركائها ووكلائها عن أي مطالبة أو مسؤولية تنشأ عن انتهاكك لهذه الشروط أو خرقك للأنظمة السعودية أو سوء استخدامك للموقع، بما في ذلك أتعاب المحاماة المعقولة.

القانون المعمول به وتسوية النزاعات

تخضع هذه الشروط حصريًا لقوانين المملكة العربية السعودية. ويتم حل أي نزاع ينشأ عنها أو عن استخدام الموقع أمام المحاكم المختصة في مدينة الرياض، وفقًا للإجراءات القانونية السعودية.

تعديل الشروط

تحتفظ باسكتبيد بحقها في تعديل أو تحديث هذه الشروط في أي وقت. وتصبح التعديلات سارية فور نشرها على الموقع. ويُعد استمرارك في استخدام الموقع قبولاً للشروط المعدلة.
